Welcome to Zone 37 ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website located at zone37airsoft.com (the "Website"), the Zoner PDA mobile application (the "App"), and any related online services, events, or activities (collectively, the "Services").
By accessing or using our Services, including by downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, you may not use our Services.
By using our Services, you confirm that you are at least 18 years old or have reached the legal age of majority in your jurisdiction. If you are accessing our Services on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
Certain features of the Services, including the App, require you to create an account. A single account is used across both the Website and the App.
You agree to provide accurate and complete information when creating your account and to keep that information current. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly at info@zone37airsoft.com of any unauthorized use of your account or any other breach of security.
You may not share your account, maintain more than one account, or use another person's account without permission. We may suspend or terminate accounts that violate these Terms. You may delete your account as described in our Privacy Policy.
Zone 37 may offer event tickets or participation passes for sale through the Website or the App.
All ticket sales are final unless otherwise stated. Refunds or exchanges may be offered only at our discretion or as required by law.
We reserve the right to refuse or cancel orders at any time, including in cases of suspected fraud or unauthorized transactions. Participation in any in-person event is additionally subject to our event rules and to the separate liability waiver you are required to sign.
a. License Grant. Subject to your compliance with these Terms, Zone 37 grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the App on a mobile device that you own or control, solely for your personal, non-commercial use in connection with our Services and events.
b. License Restrictions. You may not, and may not permit any third party to: (i) copy, modify, or create derivative works of the App; (ii) reverse engineer, decompile, or disassemble the App, or otherwise attempt to derive its source code, except to the extent such restriction is prohibited by applicable law; (iii) rent, lease, lend, sell, sublicense, or otherwise distribute the App; (iv) remove or alter any proprietary notices; or (v) use the App in any unlawful manner or in violation of these Terms.
c. Updates. We may issue updates, patches, or new versions of the App from time to time. Certain updates may be required for continued use of the App, and your continued use following an update constitutes acceptance of these Terms as they apply to that version.
d. Location-Based Features. The App includes features that rely on your device's location services to display your position on the live event map and to enable location-dependent gameplay. These features are provided as a gameplay aid only. Location data is subject to inherent limitations of GPS and mobile networks, and we do not warrant that it will be accurate, complete, or available at all times. The App is not a navigation, emergency, or safety device, and you must not rely on it as a substitute for your own situational awareness. Our handling of location data is described in our Privacy Policy.
e. In-App Conduct. In addition to the responsibilities in Section 7, you agree not to: (i) falsify, spoof, or otherwise manipulate location data or other information transmitted through the App; (ii) interfere with, disrupt, or gain unauthorized access to the App's gameplay systems, including its quest, mapping, scanning, and messaging features; (iii) use bots, scripts, or automated means to interact with the App; or (iv) exploit any bug or vulnerability to gain an unfair advantage.
f. App Stores and Third-Party Terms. Your download and use of the App is also subject to the terms, rules, and privacy practices of the app store or platform from which you obtained it (such as the Apple App Store or Google Play). In the event of a conflict between these Terms and an applicable app store's terms as they govern your use of the App on that platform, the app store's terms will control to the extent of the conflict.
The following additional terms apply if you download the App from the Apple App Store, and are provided to comply with Apple's requirements. In this Section, "Apple" means Apple Inc.
a. These Terms are concluded between you and Zone 37 only, and not with Apple. Zone 37, not Apple, is solely responsible for the App and its content.
b. The license granted to you in Section 5 is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
c. Apple has no obligation to furnish any maintenance or support services with respect to the App. Zone 37 is solely responsible for any such services and for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.
d. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Zone 37's sole responsibility.
e. Zone 37, not Apple, is responsible for addressing any claims relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
f. In the event of any third-party claim that the App or your use of it infringes that third party's intellectual property rights, Zone 37, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
g. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
h. You must comply with any applicable third-party terms of agreement when using the App.
i. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Where you obtain the App from Google Play, references to Apple above do not apply, and your use of the App is instead subject to the Google Play Terms of Service and any applicable Google policies.
You agree to use our Services lawfully and respectfully. You must not:
All content, trademarks, graphics, logos, designs, software, and other materials that make up the Website and the App are the property of Zone 37 or its licensors and are protected by applicable intellectual property laws.
Except for the limited license expressly granted in Section 5, nothing in these Terms transfers any right, title, or interest in the Services to you. You may not copy, modify, distribute, or exploit any part of our content or software without our prior written consent.
The Services rely on certain third-party providers, including Stripe, Inc. for payment processing, Google Firebase for push-notification delivery, and the Apple App Store and Google Play for App distribution. Your use of those services may be subject to their respective terms and policies. We are not responsible for the acts, omissions, content, or practices of any third-party provider.
Your data and activity within our Services are protected through SSL/TLS encryption, secure data storage, and multi-layer authentication systems. By using our Services, you acknowledge that, while we employ strong safeguards, no digital system is completely immune from security risks. Our collection and use of personal information is governed by our Privacy Policy.
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference and describes how we collect, use, and disclose your information, including information collected through the App. By using the Services, you consent to the practices described in the Privacy Policy.
All Services, including the App, are provided "as is" and "as available."
Zone 37 makes no warranties or representations about the accuracy, reliability, or availability of the Services, including the accuracy or availability of location-based features. We are not responsible for delays, interruptions, or any damages arising from the use of, or inability to use, our Services. Participation in any physical event is undertaken at your own risk and is governed by the separate liability waiver.
To the fullest extent permitted by law, Zone 37 and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data, arising from your use of our Services.
Zone 37 reserves the right to modify or update these Terms at any time, without prior notice. All changes become effective immediately upon posting on this page. Your continued use of the Services after any changes constitutes acceptance of the revised Terms. We encourage users to review this page periodically to stay informed of any updates.
We may suspend or terminate your access to the Services at any time, for any reason, including violation of these Terms. Upon termination, your right to use the Services, including the license to use the App granted in Section 5, will immediately cease, and you must stop using and delete the App.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the appropriate state or federal courts located in California.
